SEGA: THE CLUB SWEEPSTAKES

NO PURCHASE IS NECESSARY TO ENTER OR WIN
PROMOTION AND PRIZE DESCRIPTION: Pursuant to the Sega: The Club Sweepstakes on CollegeHumor.com (the "Promotion"), one (1) eligible user of CollegeHumor.com will win one (1) brand new XBox 360 and one (1) brand new copy of the Sega: The Club game for XBox 360, with an estimated retail price of U.S. $410.00 (the "Grand Prize"). Additionally, three (3) more eligible users of CollegeHumor.com will each win one (1) brand new copy of the Sega: The Club game for XBox 360, with an estimated retail price of U.S. $60.00 each (the "Prize").
SPONSOR: The sweepstakes is co-sponsored by Sega's The Club, represented by Ignited, LA, and Connected Ventures, LLC, located at 225 Park Avenue South, 17th Floor, New York, NY 10003 (collectively and individually, "Sponsor").
START AND END DATE OF PROMOTION: The Entry Period for the Promotion begins at 12:01 a.m. ET on February 4, 2008, and ends at 11:59 p.m. ET on March 15, 2008 (the "Entry Period") and the Promotion ends at 12:00 a.m. ET on March 16, 2008.
ELIGIBILITY: No purchase is necessary to enter or win the Promotion. The Promotion is only open to legal residents of the 50 United States or District of Columbia who are (18) years of age or older at the time of entry. The Promotion is void in states and/or jurisdictions where prohibited or otherwise restricted by law. The Promotion is not open to employees of Sponsor, Sega of America, Inc., and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies and each of their respective officers, directors and employees, or any persons or entities directly associated with this promotion (collectively, the "Promotion Entities") and members of the immediate families and/or persons living in the same household as such persons, and accordingly none of these persons is eligible to win the Prize.
ENTRY: To enter the Promotion, you must follow links to the Sega: The Club Microsite and Sweepstakes page on CollegeHumor.com and enter your name, email address, birthday, and agree to the Official Rules. You must enter the Promotion during the Entry Period in order to be eligible for the random drawing on March 16, 2008. Entry is free.
DRAWING & WINNER SELECTION: One (1) Grand Prize Winner and three (3) Winners (four (4) winners total) will be selected in a random drawing conducted by Connected Ventures, LLC of all eligible entrants as of 11:59 p.m. ET on March 15, 2008. This selection will be made immediately following the end of the Entry Period. Decisions of Sponsor are final and binding in all respects. The winners will be notified by e-mail on the same day as the drawing. If potential winner does not respond to email (which will be sent 5 times over a 5 day period, or if the email comes back as undeliverable an alternative winner will be selected. Odds of winning depend upon the total number of eligible entries received.
PRIVACY: Except as otherwise stated in these Official Rules, personal information collected in connection with the Promotion will be used in accordance with CollegeHumor.com's PRIVACY POLICY.
GENERAL PRIZE AND PROMOTION CONDITIONS: The winners of the Prize shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the Prize. The Prize shall be nonassignable and nontransferable. No cash alternative or substitutions for the Prize will be allowed, except that Sponsor reserves the right to substitute prize(s) of comparable value if the Prize is unavailable for any reason. The winners of the Prize may be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release or other documentation relating to the Prize (collectively, "Prize Claim Documents"). If a selected winner fails or refuses to sign and return any and all Prize Claim Documents within seven (7) business days of attempted notification, the winner may be disqualified and another winner will be selected in accordance with the procedures set forth under the caption "Drawing & Winner Selection" above.
INDEMNIFICATION: Each Promotion entrant hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of the Official Rules, or TERMS & CONDITIONS of use of CollegeHumor.com's website.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: The Promotion Entities (A) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from the Promotion or any related activity, or from entrants' acceptance, receipt, possession and/or use or misuse of the Prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to the Prize, including, without limitation, to the Prize's quality or fitness for a particular purpose. Sponsor is not responsible for providing a corresponding phone service plan to coordinate with the Prize. Sponsor assumes no responsibility for any damage to an entrant's computer system which is occasioned by accessing any website of Sponsor or participating in the Promotion, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, late, lost, damaged or stolen Prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Promotion or any website of Sponsor, to be acting in violation of these Official Rules, or to be acting in an unsportsman-like or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. In the event Sponsor is prevented from awarding the Prize or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor's control (each a "Force Majeure" event or occurrence), then Sponsor shall have the right to modify, suspend, or terminate the Promotion. If the Promotion is terminated before the designated end date, Sponsor will (if possible and in its sole discretion) select the winners from all eligible, non-suspect entrants as of the date of the event giving rise to the termination. Entrants hereby agree to release Promotion Entities from any claims, actions, injury, loss or damage or any kind, including but not limited to, personal injury or death, resulting from participating in the Promotion, inability to participate in the Promotion, or from acceptance, possession, use or misuse of any prize awarded. Any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, shall be resolved individually, without resort to any form of class action. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH PARTICIPATING IN THE PROMOTION AND PARTICIPANTS HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF PARTICIPANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
WINNERS LIST/OFFICIAL RULES: To obtain the winners names, send a self-addressed stamped envelope to "Sega: The Club Sweepstakes," Contest Winners List, c/o CollegeHumor.com, 225 Park Avenue South, 17th Floor, New York, NY 10003. All such requests must be received by April 1, 2008. These Official Rules will be posted on CollegeHumor.com.
