Last year the city I live in was doing some kind of rail-road crossing Sting/Awareness where the police randomly pulled over cars crossing the tracks and told them they had been flagged for incorrectly crossing or for stopping on the tracks. I was one of those people. The officer asked for my license and registration, then proceeded to tell me why I was pulled over. Stated, "I will assume you have insurance." Then he let me go, with out giving me a ticket. A week later a ticket shows up in the mail. No proof of insurance and blocking a traffic intersection, and the citation was for a location about 19 miles North of the actual incident. Hmmmmm. Boy was I mad!!! So, I took it to court. I showed up early. Listened to the cases before me and took note of some of the conversations between the Lawyers and the Judge. When it came my turn, the first thing the Judge asked was did I have insurance, without even hearing my story. I told him no. And he says, okay, I'll give you 90 days to get insurance and your Ticket will be dismissed. I thought about the citation location and said, "Actually, your Honor. I was wondering if you can dismiss the ticket all together? The officer cited me incorrectly, I was not at that location on that date, at that time." The Judge pulled up the Officers Notes on the traffic stop, but there wasn't any. YEAH!!!!! "Since there are no notes, we have nothing to go on and we have no option but to dismiss the ticket," says the Judge. I fought the Law and I won!!!
