To Drunk to DUI

So in MD you can still get a DUI even if you're not driving, but still in the driver's seat of a stationary car that has its engine running (prob the same everywhere not sure). Anyway, the year was highschool, the day was saturday ~2am, and the problem was our DD was hammered. As the party ended, he swore he could still drive us home, so he grabbed his keys and we stumbled into his SUV. Try as he might, my friend the DD could not start his car, and just as we were about to get out to call a cab, a cop turns on his lights and walks up to the window. Apparently he had been parked behind us the whole time, trying to catch kids DUIing from the party. Funnily enough, my friend was so drunk that the keys he grabbed were the wrong f***ing set, so he couldn't even start the engine if he wanted to. The cop realized the situation, but had nothing to charge us with other than to cite us for underage drinking (but he was a trooper and I guess he didn't want to waste his time on the 6 of us for that), so he just made us promise to take a cab and peaced. I know right, everyone hates to cab it thru tbell drive through, but we lived.
